By purchasing the ticket, you (“Ticket Holder”) agree to be bound by the Terms and Conditions of sale specified herein and any other provision as may be specified from time to time by Tides & Tunes, Zanin Entertainment, ("Promoters") or Tekin III and their company Jervis Bay Wild ("Venue"). The Promoter / Venue Owner or employees shall not be liable for any death, personal injury (unless caused by negligence of The Promoter / Venue Owner or its employees), loss damage however caused while in the venue nor are they liable for any complaints, claims, refunds, or exchange for any reason. Booking fees and handling fees shall not be refundable. Any refunds shall be made only at Promoter’s discretion.

Tickets are sold subject to the following conditions:

Once sale is completed, no refunds will be made except pursuant to event cancellation. Lost ticket/s will not be replaced or refunded but rather a credit note will be issued.

Any requests to transfer a booking to another event must be made 72 hours prior to the cruise time, are subject to availability, discretion of the organisers, price change and will incur a $20 transfer fee for each time a request is made.

Promoter reserves the right, if considered necessary, to alter the advertised pick up/drop off point, change menu, schedule, program, entertainment or seat arrangements. In such circumstances, no refunds will be made, and the promoter will not be liable for your direct or indirect loss of fares. Nor will the promoter be liable for any damage, loss, expense, loss of time, disappointment, inconvenience or any other form of loss suffered by you.

Australian and NSW law requires you to be 18 years or over to be served alcoholic beverages. The promoter and the venue reserve the right to refuse entry or stop selling alcohol if an individual is intoxicated (as per the RSA), is disorderly, aggressive or is suspected of being under the influence or in the possession of illegal substances. We reserve the right to refuse boarding / admission to any passenger deemed to be in breach of the NSW RSA guidelines, in this instance no refund will be given.

This is an over 18 event only. No one under 18 will be allowed on board and ticket will not be refunded. You will not be allowed on board without proof of age ID. No alcohol to be brought on board, there will be a bar onboard where ticket holders can purchase drinks.

The Promoter may add, withdraw or substitute artistes and/or vary advertised programmes, event times, seating arrangements, audience capacity without prior notice.
The Ticket Holder agrees to submit to any searches for prohibited items including but not limited to weapons, controlled, dangerous and illegal substances.
The Ticket Holder voluntarily assumes all risks and danger incidental to the event whether occurring prior to, during or subsequent to the actual event, including any death, personal injury, loss, damage, or liability.
This agreement is to be governed by and is construed in accordance with the laws in force in New South Wales. Any action claim suit or proceeding arising out of or connected in any way with this agreement or the events will be brought in courts of New South Wales.

Ticket holders must be at the designated boarding location 30 minutes prior to the event start time. Tekin III will leave the dock at 5pm and any ticket holders who are not aboard will not be provided a refund.

Covid-19 disclaimer

By purchasing a ticket, you acknowledge that you must comply with all restrictions and current health orders imposed by the NSW Government including the vaccine mandate. If you are deemed not to be adhering to the restrictions or health orders, the promoter and the venue reserve the right to remove you from the cruise at any time or refuse you entry, in this instance no refund will be given.
If restrictions are relaxed or tightened, and more or less tickets are issued or released, this will not affect your current booking. Your ticket will still be valid at the same rate as you initially purchased it and you will not be given the option for a refund.
In the event of further COVID-19 restrictions being placed on events that deem it not possible for the cruise to take place, ticket holders will be offered a credit for another cruise on another date at the Promoters discretion. This will only be made available if the event cannot go ahead or with further restrictions being imposed. Guests travelling from overseas or interstate understand that there may be border restrictions imposed and acknowledge that the Promoter is not liable for the guests quarantine. No refunds will be provided to guests unwilling to quarantine.

Covid–19, often referred to as coronavirus, is an infectious disease that can result in serious and potentially fatal illness. There is a risk of the transmission of Covid–19 in any environment where people come together. This risk increases in enclosed spaces and with increased numbers of people. The World Health Organisation has advised that the elderly and those with underlying medical conditions are more vulnerable.

Upon entering, a Tides & Tunes, Zanin Entertainment, or Matt O'Brien event, you assume all risk associated with Covid-19. You also agree to abide by all government guidance aimed at preventing the transmission of the virus (details of which can be accessed via the following link https://www.nsw.gov.au/covid-19/rules/greater-sydney; and follow all directions provided by staff members and set out in the signage within the venue.
