Without formal records, the Drs are bound to treat, but this can be against the patient's wishes.
The person may be forced to live in ways they would not have agreed to if they were conscious, aware and able to communicate.
As hard as it is, being another's voice when they don't have one is an important and loving role. But again, if you don't know, how can you advocate for their decisions?
