Preparing a recovery schedule during construction can have far-reaching implications, especially when it comes to evaluating delays later in the project. We will discuss the risks and complexities that arise when a project shifts from its original plan to a recovery schedule, raising critical questions about how to measure responsibility for delays. Should you rely on the original schedule, the recovery plan, or something else entirely? Through a series of scenarios, we will explore how changes in sequencing, actual progress, and planning assumptions influence the interpretation of delays, and whether a recovery schedule truly “erases the sins of the past.”

Haswanth Venkatavijayan
Haswanth is a Senior Consultant at FTI Consulting. He holds a master’s degree in Construction Management from Columbia University and brings a strong academic and professional foundation in project controls and construction claims analysis. In his consulting experience, Haswanth has played a key role in the successful resolution of complex construction claims, with his expertise in delay analysis, damage quantification, and evaluating loss of productivity impacts. He has supported both contractors and owners by monitoring schedule progress, analyzing construction sequencing, and reviewing change orders involving time extensions and cost claims.
Phillip Kenny, CCA
Phillip Kenny is a Senior Director at FTI Consulting and is based in the New York City area. Mr. Kenny has more than ten years of experience resolving construction disputes. He has prepared and presented claims on behalf of contractors and evaluated and refuted claims on behalf of owners and contractors. In his experience, Mr. Kenny has consulted on a variety of projects including airports, light rail systems, roadways, mid and high rise buildings, chemical plants, natural gas compressor stations and pipelines. Mr. Kenny also has performed on-site time studies of various contractors performing roadway construction operations. He has extensive experience performing claims analyses and quantifying damages related to schedule delays, change orders, acceleration, cost overruns, loss of productivity impacts, and similar damages.
Eric Schatz, PE, PSP, CFCC
Eric is a Managing Director at FTI Consulting with more than 20 years of experience in the construction industry, assisting owners, contractors, designers and sureties to avoid and resolve construction disputes. With a strong background in project controls and construction management, he often serves as a claims consultant expert providing schedule delay, loss of productivity, and damages analysis. Years of analyzing and preparing claims has afforded Eric with insights of poor risk management, reactive decision making and their potential consequences on cost, schedule, productivity, and quality. He uses this experience to assist parties to evaluate their exposure and resolve disputes prior to arbitration or trial.
