Abstract: In 2011, a prominent study claimed to have shown that hungry judges tend to be harsher. Today, this putative “hungry judge” effect forms a key motivation behind efforts to replace judges with AI systems. But this is woefully ironic and tantamount to replacing hungry judges with extra hungry judges. This is because the underlying problem with hungry judges is that their decisions are affected by extraneous factors rather than the merits alone. AI systems, meanwhile, categorically do away with the merits and instead generate their outputs entirely on some other basis, such as statistical predictors. Thus, whereas humans are only potentially and at most partially “hungry,” AI systems are “hungry” both necessarily and entirely. As such, aversion toward hungry judges is not a reason for judicial automation but one against it.
