December Luncheon - The Progressive Prosecutor Problem
Our final The Federalist Society luncheon of 2025 will be December 4 and feature Zack Smith, senior fellow at The Heritage Foundation, who will give a talk entitled: "The Progressive Prosecution Problem - How liberal prosecutors abdicate their responsibilities and undermine the rule of law."
Do progressive prosecutors practice prosecutorial discretion when they refuse to charge entire categories of crimes? Or, are they engaging in a more pernicious and constitutionally problematic practice of prosecutorial nullification? Zack will explore both the theoretical and practical problems with the "Rogue Prosecutor" movement.
