Where and when is the clinic?

What is a Last Will & Testament?
A Last Will & Testament, or simple a Will, is document which directs how property (and minor children) is to be distributed to beneficiaries and heirs upon a person’s death. At a LiKEN Free Will-Writing Clinic, attorneys draft "simple wills," which only address real property (i.e. land and structures affixed to land), not personal property (i.e. personal possessions like jewelry, heirlooms, vehicles, etc.).

What do I need to bring?
The only thing you need to bring is some form of identification (i.e. drivers license, state ID, etc.). If you have multiple properties, bringing a deed or any other property records may make the will-writing process easier.

What do I do with a Will?
If you obtain a will at a LiKEN Free Will-Writing Clinic, you will walk out with the original copy of the Will. Keep that copy in a safe location and tell a trusted individual where it is located. Your family will need to access the Will after you pass away to probate your estate. Attorney Joe Childers of Childers & Baxter PLLC will keep a copy of the will in his office at 201 W Short St Suite 300, Lexington, KY 40507. In case the original copy is misplaced or damaged, you can receive a copy of your Will by contacting the Childers & Baxter PLLC at (859) 253-9824.

Why should I make a Will?
If you own property and pass away without a Will, your property will be distributed according to Kentucky's intestate succession law (KRS 391.010). Depending on your family situation (if you have a living spouse, children, parents, sibling, etc.), passing away without a will may put your property into heirship, meaning that the property is owned by more than 1 living heir, each of whom owns a fractional interest in the property as co-tenants. Heirs' property typically results in the title to the property becoming "tangled" or "clouded," which, in turn, makes the property vulnerable to dispossession and abandonment. Creating heirs' property should be prevented where possible. Writing a Will that clearly distributes property among the heirs, without creating a co-tenancy situation, is one way that you can prevent your property from becoming heirs' property. If you are already an heir/co-tenant to a property, a Will can mitigate the fractionalization of interests in the property.
