This presentation examines the Philippines’ use of legal means in asserting its claims in the West Philippine Sea as a manifestation of the Filipino political elite’s legal culture. This aspect of legal culture did not come about as a result of the tension with China. Instead, it developed over time alongside the
formation of the Philippine state. The early stages of this development, particularly under the American colonial period, set the pathways for the legal culture that we see today, and which paved the way for the arbitration procedure.
