- **Event Description**: This training will discuss fraud in closely-held entities, how to apply forensic frameworks, and analyzing control deficiencies .About this Event  https://cdn-az.allevents.in/events2/banners/35cd6380-a0df-11f1-8382-27c8b4f8dbac-rimg-w1200-h671-dcf8f8f8-gmir.png When two branches of a family jointly owned a portfolio of Manhattan real estate properties, one family member entrusted with sole day-to-day management authority allegedly exploited that position over more than a decade to divert tens of millions of dollars through a multi-faceted scheme of self-dealing, asset misappropriation, and gross mismanagement.This presentation walks attendees through the forensic accounting investigation that uncovered and quantified hundreds of millions of damages across seven distinct categories of fraud:Disproportionate capital and loan distributions inconsistent with ownership interests;Excessive management fees paid to an entity the manager controlled;Personal use of company-owned apartments by family and household staff;Payment of personal expenses with company funds;Failure to pay property taxes;Chronic code violations and fines from an illegally erected billboard and unpermitted renovations; andSustained above-market vacancies driven by neglect.Using an anonymized case study, the presenters will demonstrate how the conduct maps onto both the ACFE Occupational Fraud Taxonomy (asset misappropriation, corruption, financial statement fraud) and Cressey's Fraud Triangle (pressure, opportunity, rationalization). The session will detail the forensic methodologies used to quantify each loss category, including capital account reconciliation, management fee benchmarking against arm’s-length comparables, vacancy loss modeling with market data, and personal expense tracing through general ledgers.Learning ObjectivesIdentify red flags of asset misappropriation and self-dealing in closely held, family-controlled entities;Apply the ACFE Occupational Fraud Taxonomy and Cressey's Fraud Triangle to a complex, multi-scheme fraud matter;Understand key forensic accounting methodologies for quantifying damages across multiple fraud categories; andRecognize how family dynamics, absence of independent oversight, and weak internal controls enable long-running occupational fraud.About the SpeakersElias Levinowitz, JD, MBA, CPA, CFE - Elias Levinowitz is an associate director at BRG (Berkeley Research Group) and is based in Houston. Mr. Levinowitz specializes in forensic and investigative accounting, financial and economic analyses in disputes, and data-driven litigation support. He develops testimony-ready analyses, manages complex electronic evidence, and presents findings in matters involving alleged fraud, commingling, related-party activity, wage-and-hour claims, and other commercial disputes. His practice encompasses economic damages in commercial disputes and class actions; tracing of funds and related-party transactions; alter ego and veil-piercing analyses; accounting and financial reporting issues, including GAAP topics related to consolidation, revenue and expense recognition, and intercompany activity; mergers and acquisitions and post-transaction disputes, including purchase price adjustments, earnouts, and representations and warranties; valuation services and opinions; intellectual property; and financial services litigation and investigations. Mr. Levinowitz has been retained as an expert and has served as engagement lead on matters involving personal injury damages, election investigations, marital asset tracing, and wage-and-hour disputes. He has prepared expert reports and supported deposition and trial testimony on valuation, damages, and other financial issues across litigation and bankruptcy matters. He earned a JD/MBA from Tulane University and a BS in Finance with a minor in Accounting from Clemson University. He is a Certified Public Accountant and a Certified Fraud Examiner. He serves as President of the Board of Directors of the Prelude Music Foundation, a Houston-based nonprofit dedicated to transforming the lives and educational outcomes of young children through music education.Kenneth Mathieu, CPA/ABV/CFF - Kenneth Mathieu is regularly retained as an expert witness for matters involving accounting, damages, and complex valuation issues. Utilizing his experience serving as a trusted advisor to entities facing a material decision or a crisis, such as a merger, high-stakes litigation, or government investigations, he provides credible and objective analysis and information to mitigate the crisis and resolve the matter. Boards, insurance companies, courts, arbitrators, management, and governmental agencies utilize the results of his analysis to assist in making critical decisions. He is a member of the American Institute of Public Accountants and the Illinois CPA Society and has held leadership positions with both organizations. He currently serves as a commissioner on the National Accreditation Commission of the AICPA, which oversees all specialty credentials the AICPA issues. He frequently speaks on forensic accounting, valuation, and damages at industry conferences and educational forums. He has published articles for peer-reviewed journals and co-wrote chapters in books widely considered reference guides for the forensic accounting and valuation professions. He also served as the editor for AICPA Practice Aids for forensic accounting professionals. He is a CPA (licensed in Illinois and Louisiana) and is Accredited in Business Valuation by the AICPA and Certified in Financial Forensics by the AICPA. He earned an MBA from Northwestern’s J.L. Kellogg Graduate School of Management in finance, management, and strategy. He was previously an international accounting fire, where he held a leadership role and served as a GAAP expert.The training will be held via Zoom webinar. The stream link and additional details are provided on the online events page after registration.This is an hybrid in-person and online training event which will be held at the 2 Main (also referred to as Gateway Tower West) at 15 West South Temple between Bennion Jewelers and Key Bank in downtown Salt Lake City on September 1st from 12:00 to 1:00.We recommend entering the garage from South Temple. After taking the driveway down, stay right to enter the garage. Turn left after taking a ticket. You will see a sign that reads “Gateway Tower West” or “2 Main” above directing you to take another left. Park as close to this area as possible. The entrance to the building is between P1 West Zone B and Zone C though the double glass doors on the north side. Go through the doors, take the stairs or the ramp to the left, follow the hallway and you will arrive at security.If coming from West Temple, you will arrive at P2. Make your way back up to P1 and look for P1 West Zones B and C on the North side.All attendees will be required to check in with security. A member of the ACFE will be stationed at both entrances to assist. The meeting will be held on Floor 2 in the meeting room attached to the lounge. Parking validations will not be provided. City Creek offers up to two free hours.Box lunches from Apple Spice will be provided and included in the cost of an in-person ticket.
