Hollis "Cee" Stephens Land Covenants & Restrictions

1. These covenants and restrictions apply to Tracts 1 through 32. Tracts 33, 34 and 35 are not subject to these restrictions.
2. Unless agreed to by 100% of property owners of Tracts 1 through 32, these covenants and restrictions may not be waived or terminated but shall continue to run with the land and be a restriction on the use of same.
3. No single wide mobile homes allowed. No double wide mobile homes allowed.
4. All dwelling construction shall be on-site and of new materials. All dwellings shall contain a minimum of at least 1,250 square feet of heated floor space, excluding carports, basements, attached garages & porches. Pier-type foundations may be used for porches and decks, but no open-pier type foundations for the dwelling may be used. All construction must be completed within one year after construction begins. Minimum building set back distance of 30 ft from roadway easements and 10 ft on sidelines. "Barndominiums" are welcome as long as in compliance with all other provisions. New portable outbuildings are allowed, but not for dwelling purposes.
5. Restricted against junk, junk yards, salvage yards, abandoned or inoperable vehicles of any type, and total confined feed lots that would create a nuisance to a neighboring tract in this division. Normal agriculture practices for free-range cattle and horses are permitted on tracts 5 acres or larger or a combination of contiguous tracts totaling 5 acres or larger, with fences to be kept in good repair. Chickens for personal household egg consumption are permitted; however, they must be confined so not to create a nuisance to other landowners. No other livestock permitted. No commercial dog kennels or dog-boarding facilities allowed. Crop and garden planting are permitted.
6. Tracts 1, 2, 3, 29, 30, 31 and 32 are considered residential, commercial or multi-family. All other tracts are restricted against multi-family dwellings or commercial use; except, a home-based business that is operated inside the structure of the primary dwelling will be allowed.
7. Temporary RV access will be permitted on tracts 4 acres or larger or a combination of contiguous tracts totaling 4 acres or larger, not to exceed a 30-day period at any one time. Limit 2 RVs per 4-acre tract. RV limitations do not apply to commercial / multi-family tracts.
8. Property tracts to be mowed at least twice yearly, and property to be kept neat and clean in appearance. All developed lots and tracts shall conform to all state and local health sanitation regulations.
9. There is reserved a 15 ft general utility easement along all roadway easements and a 10 ft general utility easement along tract division lines as needed if the property is purchased in tracts.
10. If 100% of property owners of Tracts 1 through 32 agree to modify, change, add or delete any or all covenants and restrictions of this division, they may do so by amending, in writing, said covenants and restrictions and have recorded in the Russell County Clerk’s Office.

TERMS: REAL ESTATE: Non-refundable 10% down day of sale & balance with deed on or before 30 days. No contingencies. 2025 property taxes will be paid by the Sellers. Possession with deed.
