LaSalle, a recent Second Circuit decision examining how New York handles complaints against lawyers and how much of that process should be open to the public.For decades, complaints alleging professional misconduct by New York attorneys have been handled largely behind closed doors. In Civil Rights Corps, the Second Circuit held that, as applied to the plaintiffs' complaints, the First Amendment provides the public with a qualified right of access to certain aspects of the attorney disciplinary process, including formal proceedings, records necessary to understand them, and certain final decisions issued by grievance committees. At the same time, the court emphasized that confidentiality may still be justified in particular circumstances.The decision raises important questions about transparency, accountability, and privacy. When should the public be able to see how complaints against lawyers are resolved? When is confidentiality necessary to protect attorneys, clients, witnesses, or sensitive information? And how can the disciplinary system maintain public confidence while safeguarding legitimate privacy interests?Our panel features Gregory Diskant, Of Counsel, Patterson Belknap Webb & Tyler LLP; Nicole Smith Futrell, Clinical Professor of Law, Columbia Law School; Leslie Levin, Hugh Macgill Professor of Law Emerita, University of Connecticut School of Law; and Dante Apuzzo, Litigation, Pillsbury Winthrop Shaw Pittman LLP.The discussion will be moderated by Kate Levine, Professor of Law and Co-Director of the Jacob Burns Center for Ethics in the Practice of Law.The program will conclude with an audience Q&A designed to engage practitioners, academics, students, and members of the public in a discussion of transparency, confidentiality, and accountability in attorney disciplinary proceedings.One CLE credit in Ethics and Professionalism is pending for both transitional and non-transitional New York State attorneys. Once CLE credit is approved, attorneys must attend the program in person or "live" to receive credit. We cannot award CLE credit for viewing a recorded version of any portion of this program. For attendees participating remotely, a Zoom webinar link will be provided in advance on this Eventbrite page upon CLE approval and prior to the event.The case material will also be provided.
