Garrett Ripa. Kristi Noem and Pam Bondi in their official capacities.This CLE presentation will address the use of habeas corpus petitions to challenge bond denials and custody determinations in immigration cases governed by INA § 235, including matters involving noncitizens who entered without inspection (EWI). Attorney Felix A. Montañez will discuss the successful arguments and litigation strategies that supported his recent habeas corpus victory in the Southern District of Florida, where the court reviewed the legality of a detention under § 235(b).The program will explore the evolving federal jurisprudence on habeas review in the immigration context, the intersection between statutory detention provisions and constitutional due process, and the procedural steps necessary to bring and sustain habeas challenges on behalf of detained immigrants. Attendees will learn how to identify viable habeas claims, structure persuasive pleadings, and coordinate advocacy between immigration and federal courts.Attorney Skip Pita will talk about the Importance of Habeas Corpus to Protect Liberty Interests in Immigration Enforcement.Habeas corpus—the “Great Writ”—remains one of the most powerful legal tools to safeguard individual liberty against unlawful detention. This presentation will explore the continuing relevance of habeas corpus in the context of modern immigration enforcement, particularly when federal agencies engage in questionable or extrajudicial arrest practices. Attorney Howard “Skip” Pita recently filed a federal habeas corpus petition on behalf of an immigrant who was arrested by masked ICE agents outside a federal immigration courtroom in South Florida. The case raises profound constitutional questions about due process, access to counsel, and the limits of executive authority in immigration enforcement. The discussion will highlight how habeas corpus functions as a vital check on government power, ensuring judicial oversight whenever liberty is threatened, especially in contexts where noncitizens may otherwise have limited procedural protections.
