- **Event Description**: At the City’s March 2, 2026 worksession, it was revealed by Mayor Colvin that the City of Fayetteville’s Planning Commission (which is staffed by unpaid, volunteer residents), had been quietly working on a data center ordinance since October 2025. The public only found out about it after a motion was made by Councilman Shaun McMillian (District 7) to request the City Council direct staff to begin researching policy options for regulating data centers and look into a data center moratorium. The motion failed. Mayor Colvin has been very publicly supportive of data centers and resistant to local regulations. 

The draft ordinance would allow developers to build data centers ‘by right’ in industrial zones. Projects would get automatic approval as long as it meets the city’s zoning standards—meaning no public input and no opportunity for the city to add conditions. To protect residents, many cities around the US are requiring data center developers to have a special use permit, which often requires a public hearing process, noise/environmental studies or regulations, and more.

We are calling on the City of Fayetteville and Cumberland County to both pass a one-year moratorium on data centers!
